Tree Surgeons Camden Terms and Conditions

Tree surgeons carrying out professional arboricultural workThese Terms and Conditions set out the basis on which tree surgery services are provided by our team of tree surgeons in Camden. By making a booking, accepting a quotation, or allowing work to proceed on site, the customer agrees to these terms. They are designed to create clarity around the booking process, payment expectations, cancellations, liability, waste handling, and the law that applies to the contract. If any part of these terms is not understood, it is the customer’s responsibility to seek clarification before the work begins.

Throughout this document, references to “we”, “us”, and “our” mean the service provider carrying out the work, and references to “you” and “your” mean the customer, homeowner, landlord, managing agent, business, or other person requesting the work. These terms apply to all standard and specialist services offered by tree surgeons Camden, including pruning, crown work, felling, stump-related services, emergency tree work, and associated vegetation management, unless a separate written agreement states otherwise.

Nothing in these terms affects your statutory rights as a consumer where applicable. If a provision is found to be invalid or unenforceable, the remaining provisions will continue to apply. These terms may be updated from time to time, and the version in force at the time of booking will normally apply to the relevant works. 1. Booking Process

All bookings for tree surgery services in Camden are subject to availability, site conditions, and acceptance of a quotation or estimate. A booking may be made by telephone, email, online request, or other agreed method. However, a booking is only confirmed when we have acknowledged the requested work and, where required, received any deposit or written acceptance of our terms. An enquiry or provisional date does not guarantee availability until confirmation has been issued.

Before any work is scheduled, we may require information about the trees, access arrangements, the size of the property, nearby hazards, parking restrictions, preservation constraints, and any known defects or infestations. The customer must provide accurate and complete information. If incorrect or incomplete information is supplied, the scope of work, timing, and price may need to be revised. We may also request photographs, maps, or a site visit before confirming the booking.

For certain works, including large-scale pruning, tree felling, or works involving access restrictions, a site inspection may be necessary. The booking process may also involve confirmation of ownership or authority to instruct the work. You must ensure you have the legal right or permission to request work on the relevant tree or land. 2. Scope of Services

The services supplied by Camden tree surgeons will be limited to the items described in the quotation, written estimate, or agreed scope of work. Any additional tasks requested on site, including extra dismantling, stump treatment, log splitting, waste removal beyond the original allowance, or emergency mitigation, may be chargeable as an additional service. We are not obliged to carry out work outside the agreed scope unless we expressly agree to do so.

We will use reasonable skill and care in carrying out the works, but trees are living organisms and results can vary depending on species, health, structure, weather, and prior management. Recommendations provided before or during work are based on visual assessment and the information available at the time. Unless specifically stated in writing, no guarantee is given that tree condition, future growth, or structural stability will remain unchanged after completion.

If the customer requests a particular method, finish, or outcome that differs from our professional recommendation, we may decline the instruction if we consider it unsafe, unlawful, or inconsistent with accepted arboricultural practice. We reserve the right to amend the method of work where necessary to ensure safe completion, protection of adjacent property, or compliance with relevant standards and legal requirements.

3. Pricing and Payments

All prices will be set out in the quotation or estimate, unless the nature of the work makes it necessary to provide an indicative price subject to final inspection. Prices may be quoted inclusive or exclusive of VAT, and this will be made clear where applicable. Unless otherwise agreed in writing, quotations remain valid for a limited period and may be withdrawn or revised if the scope, site conditions, or material costs change before booking.

Payment terms will be specified in the quotation, invoice, or confirmation. Standard payment is usually due upon completion of the work, unless a deposit or staged payment arrangement has been agreed. We accept payment by the methods stated in our invoice or booking confirmation. Where a deposit is required, the booking may not be secured until the deposit is received in full.

If payment is not made on time, we reserve the right to charge statutory interest and reasonable recovery costs where permitted by law. Any discount, promotional price, or special rate will apply only to the exact services stated and will not extend to additional work unless confirmed in writing. All invoices must be paid in full without set-off or deduction unless required by law. Scheduled tree work with access and property protection measures

4. Cancellation, Rescheduling, and Delays

You may request to cancel or reschedule a booking by giving notice as soon as reasonably possible. Where the cancellation is received after the booking has been scheduled and resources have been allocated, cancellation charges may apply to cover administration, travel, staffing, and lost time. Any deposit paid may be retained or partly retained where permitted and where the loss incurred is reasonable and proportionate.

If access is not available, permission has not been obtained, necessary parking cannot be secured, adverse weather creates unsafe conditions, or the site is otherwise unsuitable on the day, we may postpone the works. In such cases, a call-out, waiting time, or wasted attendance fee may be charged if the issue arises because of information not disclosed by the customer or circumstances within the customer’s control. We will always seek to act fairly and reasonably.

We may also reschedule or suspend work where staff safety, equipment integrity, third-party property, or compliance with law would be compromised by continuing. Weather-sensitive services, including certain tree surgeon operations involving climbing, lifting, or sectional dismantling, may be delayed because of wind, ice, heavy rain, darkness, or other unsafe conditions. Where possible, we will offer an alternative date. Final section of tree surgery terms and conditions on a document

5. Customer Responsibilities

You are responsible for ensuring safe and suitable access to the site, including permission to enter, access routes, parking arrangements, and the removal or protection of obstacles where requested. Any fragile items, garden furniture, ornaments, cables, appliances, vehicles, or other belongings that may be affected by the works should be moved or protected in advance unless we have agreed in writing to do so. We may refuse to proceed if the site is unsafe or if reasonable preparations have not been made.

You must inform us before work begins of any known hazards, including underground services, overhead cables, nesting birds, bat roosts, protected species, unstable structures, contamination, or hidden obstructions. The customer is responsible for advising us of any legal restrictions affecting the tree or land, such as preservation controls, conservation requirements, lease limitations, or landlord permissions. Failure to disclose such matters may result in delay, additional charges, or cancellation of the works.

If a third party is present on site, including neighbours, tenants, contractors, or visitors, you must ensure they remain clear of the working area unless we have agreed otherwise. Children and pets should be kept away from the area during operations. We may stop work if we consider the site unsafe due to interference, obstruction, or unauthorised access by others.

6. Liability and Limitations

We will take reasonable care to avoid damage to property, but certain risks are inherent in tree work. Minor scuffs, indentations, or disturbances may occur where heavy equipment, ropes, timber, or waste have to be moved through confined access. We are not liable for damage resulting from pre-existing defects, hidden weaknesses, subsurface conditions, or information withheld by the customer. Where damage is caused by our proven negligence, our liability will be limited to the extent permitted by law.

We do not exclude liability for death or personal injury caused by our negligence, fraud, fraudulent misrepresentation, or any other liability that cannot lawfully be excluded. Subject to that, we will not be liable for indirect loss, consequential loss, loss of profit, loss of business, loss of opportunity, or any other economic loss not directly caused by our breach. Nothing in these terms limits your rights in relation to services that are not carried out with reasonable care and skill.

Tree surgery can reveal hidden defects such as decay, deadwood, cavity formation, unstable unions, or root issues. If such conditions are discovered, we may stop work or alter the scope for safety reasons. Any advice given about the condition of a tree is based on visual inspection and professional judgment, and does not amount to a structural engineering guarantee, a legal compliance certificate, or a complete diagnostic assessment unless expressly agreed. 7. Waste, Green Materials, and Environmental Compliance

All waste arising from the service, including branches, leaves, timber, stumps, sawdust, and other green waste, will be handled in accordance with applicable waste regulations. Unless otherwise stated in the quotation, waste removal forms part of the service where it has been included in the price. Where the customer requests that timber, logs, woodchip, or arisings be left on site, this must be agreed in advance and may affect pricing, access, and safety.

We will dispose of waste only through lawful and appropriate routes. Waste may be transported by authorised means to licensed facilities or managed in a manner consistent with environmental obligations. The customer must not ask us to leave waste in a manner that breaches the law, causes nuisance, blocks access, or creates a hazard. We may refuse instructions that would result in unlawful disposal or improper storage of arisings.

If the customer wishes to keep any material, they must specify this before the work begins. Once waste has been removed from the site, it becomes our responsibility or that of our appointed waste handler, subject to the arrangement made. We are not responsible for the later use, storage, or disposal of material that has been lawfully transferred away from the site. Team preparing a quotation and site inspection for tree surgery

8. Access, Property, and Site Conditions

We will exercise reasonable care when working near buildings, boundary structures, fences, lawns, paving, and planted areas. However, the customer acknowledges that tree surgery may require equipment to be positioned on surfaces that could be marked, compressed, or disturbed. Where appropriate, protective measures may be used, but their effectiveness can depend on conditions beyond our control. We are not liable for wear or disturbance that is reasonably incidental to the service.

If special access equipment, traffic management, road permissions, or lifting arrangements are required, these may affect the quotation and timing. The customer must disclose any access limitations in advance. Where a site visit reveals that the stated conditions differ materially from the actual conditions, we may revise the price or decline to proceed if the work cannot be completed safely and lawfully under the original arrangement.

Any items left in the working area are left at the customer’s risk unless we have expressly agreed to move or protect them. We recommend that the customer confirms adequate insurance for belongings, outbuildings, soft landscaping, and other vulnerable features before work starts. This is particularly important where the work involves large sections, cranes, or dismantling operations.

9. Complaints and Service Issues

If you believe there is an issue with the service, you should notify us within a reasonable time after completion. We may ask for photographs, a description of the concern, and an opportunity to inspect the matter. Where a genuine fault has occurred, we will assess whether remedial work, a partial refund, or another reasonable remedy is appropriate. We will not be responsible for issues arising from new damage, weather events, third-party interference, or normal natural changes after the job is complete.

Complaints will be considered fairly and on the basis of the agreed scope, the condition of the tree, and the circumstances at the time of work. Dissatisfaction with the natural appearance of a tree after pruning does not, on its own, mean the service was defective if the work was carried out as agreed and in line with professional practice. The customer is expected to allow reasonable access for inspection or remedial action where appropriate.

Any request for correction does not waive our right to rely on these terms or to investigate the cause of the issue. Where a complaint is made, the customer must continue to keep the affected area safe and must not undertake remedial action by others without giving us a reasonable opportunity to respond, unless urgent safety measures are necessary.

10. Governing Law

These Terms and Conditions, and any dispute or claim arising out of or in connection with them, shall be governed by and interpreted in accordance with the laws of England and Wales. The parties agree that the courts of England and Wales shall have exclusive jurisdiction, subject to any mandatory consumer rights or alternative dispute resolution process that may apply under law.

If a disagreement cannot be resolved directly, both parties should act reasonably and attempt to resolve the matter through written communication and, where suitable, negotiation before commencing formal proceedings. Nothing in this clause prevents either party from seeking urgent injunctive relief where necessary to protect property, safety, or legal rights. These terms are intended to support clear, fair, and lawful engagement with tree surgeons Camden services.

Tree surgery operations with safety equipment and managed wasteBy proceeding with a booking, the customer confirms that they have read, understood, and agreed to these terms. The agreement forms the basis of the contract for any tree surgery work undertaken, including standard arboricultural maintenance, emergency interventions, and related waste handling arrangements. Scheduled tree work with access and property protection measuresIf you require a separate written contract for specialist works, that agreement will take precedence over these terms to the extent of any inconsistency.
